California DUI Penalties

First offense -
  • Summary or informal probation for three to five years
  • Fines of between $390 and $1,000
  • Up to six months in county jail
  • Driver's license suspension for six to ten months; most individuals may have the suspension converted to a restricted license, which makes it possible to drive to and from school, work, or DUI school.
Second offense -
  • Summary probation for three to five years
  • Fines of between $390 and $1,000
  • Up to one year in county jail (96 hours minimum)
  • Driver's license suspension up to two years, with no eligibility for a restricted license before twelve months
  • 18 months to 30 months completion of DUI school, court approved
Third offense -
  • Informal probation three to five years
  • Fines of between $390 and $1,000
  • Up to one year in county jail (120 days minimum)
  • 30 month DUI education program approved by the court and successfully completed
  • Driver's license revocation period of three years, with no eligibility for a restricted license before 18 months

Other criminal penalties may apply depending on whether an accident occurred as a result of impaired driving, or whether anyone was injured or killed.
