Los Angeles Attempted Murder Charges

Simply stated, it is a crime to attempt to commit a crime. When an individual intends to commit a crime, or takes significant steps even though those steps may be ineffective toward committing a criminal offense, he/she may be charged and punished. What are referred to as 'inchoate' (incomplete) crimes will leave someone who is convicted facing harsh criminal penalties.

As a highly regarded Los Angeles criminal law firm, we have defended countless individuals throughout California charged with serious and/or violent offenses such as murder, homicide, and other crimes considered high-level felonies. When you are facing serious criminal charges that may result in prison time and substantial fines, it is urgent to choose an attorney who understands the enormous time, resources, and commitment essential to develop a strong and effective defense strategy.

California Law & Allegations of Attempted Murder

Any person who is convicted for attempted murder in California may face a sentence of life in prison. In order to reach your desired outcome, it is imperative you consult with a Los Angeles attempted murder lawyer who is capable of building a vigorous defense. The laws regarding attempted murder in the state are highly complex:

  • It must be proven by the prosecutor that you had the intent to kill the alleged victim. Proving that you had the intent to injure the victim is not sufficient.
  • Although an individual may have 'planned' to take someone's life, the state must prove that a direct step was taken toward killing someone else. This element may be proven when there is evidence for example that you shot a firearm at an individual's chest or head, or paid another individual to carry out the murder.
Los Angeles Attempted Murder Penalties

While the penalties for an attempted crime are not as severe as those handed down to individuals who actually committed a crime, they are still serious. Generally speaking, someone who is found guilty of attempting to commit a criminal offense will be punished by one-half the term of prison time that usually applies when someone is convicted for completing the crime. Exceptions include:

  • Individuals who attempt to commit a crime for which life in prison or death is the maximum sentence may be imprisoned for five, seven, or nine years.
  • Attempted murder in which elements of premeditation, deliberation, or willfulness are proven will be punished by a prison term of life with the possibility of parole.

Regardless of the situation or circumstances, the penalties are harsh. Not only are the consequences tough in terms of imprisonment and fines, your reputation and career will be negatively impacted.

I moved to another state and missed court. They issued a warrant. I called the Justice Firm and spoke to Joe Virgilio and he was very helpful. The they were able to get the warrant removed and fixed it so I got probation and could go back to work. Neal R.

My mom called the Justice Firm. I had a public defender who was pushing me to take a bad deal. My new attorney Mr Browning was able to get my case dismissed. They also gave me a number for a bondsman who gave a great price so I could get out and get back to work. Carlos G.

My son had the lawyers at the Justice Firm represent him. They were really good. Mr. Hunt always calls me back to answer my questions and let me know what is going on. We have referred several people to them over he last few years and they all thank me for it. They work with the district attorneys to get good results. Rick Q.
